Pinnacle Yachts, Inc., its related companies, and the Pinnacle Foundations, NFP (collectively referred to in this document as “Pinnacle”) have implemented this Privacy Policy which describes what information we collect, how we collect it, and what we do with it once it has been collected.

Information About You

Your Information refers to information including, but not limited to, your name, address, contact details, date of birth, boat ownership, boating experience, boating accident and insurance history, boating education and certification, emergency contacts, physical and mental fitness to operate a boat, drug, alcohol and felony charges, criminal records, credit card and billing, medical insurance, employment and employment history, and home ownership, that you supply us, or is supplied to us, including any information about other persons involved with you relating to our boats and services (referred to in this document as “Your Information”). Your Information is collected when you request information from us, contact us (and vice versa), apply for membership, lease or rent our boats, participate in our training courses, and participate in our events. You are responsible for ensuring that other members of your party are aware of our Privacy Policy and consent to your acting on their behalf in all your dealings with us. We will update Your Information from time-to-time making our best efforts to keep it current, accurate and complete.

Our Use of Your Information

We may disclose Your Information to our employees, contractors and to companies who act on our behalf, and to our service providers operating systems or business functions on our behalf. These purposes include, but are not limited to, providing our products and services (and contacting you when necessary); improving our products and services; administration; customer care; training and education; safety; business management and operation; reorganization and restructuring; sale of our assets, business or related companies; risk assessment; security and crime prevention; research and analysis; sales and marketing; bookkeeping, accounting and taxations; finance; monitoring, measuring and assessing customer purchasing preferences and trends; dispute resolution; credit checking and debt collection. We may also provide Your Information to governmental agencies as required by law.

Further confidentiality terms and conditions regarding Your Information are also agreed-to by you and by Pinnacle, when you submit an application for membership, sign a lease, register for a training course, submit your scheduling information, register for an event, make payment by credit card, and at other times, all of which are incorporated into this Privacy Policy by reference. It is your responsibility to understand all such terms and conditions incorporated by reference.

Privacy of Children

Pinnacle does not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and learn that your children have provided us with personal information, please inform Pinnacle immediately using the contact information provided above. If Pinnacle becomes aware that we have collected personal information from children under age 13 without parental consent, we will take steps to remove such information.

Marketing

From time-to-time Pinnacle may contact you with information on offers for goods and services, products, events and other matters. By visiting our websites, you to agree to electronic communications from us for marketing and promotional purposes. You will be given the opportunity on most direct electronic communication from Pinnacle to indicate that you no longer wish to receive our electronic direct marketing material.

Monitoring

To deliver and help improve our services, and in the interest of safety and security, we may monitor and / or record (i) radio transmissions, telephone calls, emails and text communications between you and Pinnacle employees and contractors, law enforcement, the United States Coast Guard and other governmental agencies, (ii) your activities using audio, video, and position recording equipment on, in and around our boats, docks, parking areas and other premises, (iii) member communications and activity between you and other members. All recordings are and shall remain Pinnacle’s sole property.

Your Rights

You have the right to ask in writing by contacting us to request a copy of the information we hold about you (for which we may charge a fee) and to correct any inaccuracies in your information.

You have the right to ask in writing not to receive marketing material about our products and services. If the following facilities are available, you can amend your previous preference on our website using our “unsubscribe e-mail”, in literature which you subsequently return to us or by writing or calling us. Once properly notified by you, we will take steps to stop using your information in this way.
